Practice Overview 

My practice focusses on working with families, fiduciaries, and beneficiaries to identify and achieve their trust and estate planning and administration goals. Providing peace of mind to clients is the ultimate objective in each relationship; the best way to provide this peace of mind is by building close relationships with my clients and staying ahead of developments in the law in a rapidly changing world. While tax, trusts, and estates may seem like a dry area of the law, clients and advisors I collaborate with know that my genuine passion in the area and helping my clients is what energizes me each day. That dedication to my field and practice is what drives the delivery of consistent service to my clients.  

I provide practical, thorough, and creative probate, estate administration, and post-mortem estate planning solutions. Prior to entering private practice, I had the opportunity to work in a probate court. This gave me an excellent education in procedural rules and court processes. The formative experience gave me a front row view to the challenges families faced with estate planning and administration. My dedication to probate continues to this day as a co-author of a book on the topic (LexisNexis Practice Guide: Connecticut Probate and Estate Administration) and serving on the Connecticut Probate Court Rules Advisory Committee. In addition to appearing in probate courts throughout Connecticut and surrogate's courts in New York, I assist fiduciaries and accountants with the estate tax reporting obligations by either preparing the estate tax returns or collaborating with other tax preparers to provide an additional level of review. In the event that a return is selected for audit by the Internal Revenue Service, Connecticut's Department of Revenue Services, or New York's Department of Taxation and Finance, I assist fiduciaries and/or other tax preparers in the examination by providing a robust defense of the return and practical guidance on resolving issues with the relevant taxing authority. 

As an estate planner, my practice is informed by my experience with estate administration. My clients have a wide range of exposure to estate planning when the come to me. Some clients have never done an estate plan while others have been planning for decades and are looking for a review of their existing structure. Estate plans cannot be crafted or judged by how they operate in theory or on projected tax savings under current law; rather, on how that structure will perform under stress and on its ability to adapt to both foreseeable and unforeseeable challenges in the years ahead. To design an effective plan, it is essential to start with a strong foundation by understanding the client's goals and how they would want common challenges to be addressed. As part of this exploratory process, I am transparent about the various advantages, disadvantages, and administrative burdens of various structures so that the client may make informed decisions understanding the implications of various techniques. This leads to the creation of documents that implement these wishes by taking advantage of modern estate planning tools and building in the requisite amount of flexibility needed.  I encourage clients to maintain a dialogue with me after the documents are executed to ensure that changes in client objectives, family circumstances, and changes in law are accounted for.

Why I Created Dungey Dougherty PLLC

This was the job I was born to do and this firm was created to ensure I can do it in a way I believe for decades to come. My family began practicing law in Greenwich, Connecticut in 1930. For over nine decades and across four generations, we have continuously served our clients and community. That type of longevity doesn't happen by accident, but by consistent commitment to top-notch client service and always striving to perfect one's craft. That value was engrained in me long before I went to law school and is at the heart of this firm's vision for what a private client practice should be. I am looking to simplify the business of law and my thesis is simple--if you put the client first and invest all resources of the firm into delivering for the client then everything else will fall into place.

I wanted a firm where each client found there was accessibility, accountability, and transparency.

  • Accessibility: With private client work, the relationship between the client and the attorney is crucial to the success of the engagement and the client having peace of mind. The relationship is not possible if the attorney cannot readily be reached. To ensure there is access to each attorney, we limit the number of clients we take so that each client is able to reach their attorney on a same day basis. 
  • Accountability: Top-notch services means delivering what is needed and expected by clients without them having to chase for it. As it relates to quality and reliability--every person at this firm needs to be accountable to ensure we deliver what is promised.  
  • Transparency: Legal services should not be shrouded in secrecy. We want clients to understand the process; we encourage questions and provide feedback so we can continue to evolve to meet the needs of our clients.   

In addition to serving our clients, I also believe there is an obligation to give back to a profession that has given my family so much over the years. This is why I volunteer in various professional organizations with a real passion for developing educational programs for practicing attorneys and law students. I write and present extensively not only to give back, but also because I genuinely enjoy the academic side of the practice and it allows me to collaborate with talented practitioners.  A complete list of past presentations and publications is included below.
